Consent for use of images
Consent before photography
When you publish, share or use images, films or sound recordings, you must comply with section 104 of the Copyright Act (lovdata.no). There must be written, informed and voluntary consent for all media material that requires this. Below are collected examples of images that are often used in connection with OsloMet. You can find more information about image use on the Norwegian Data Protection Authority's website about sharing images (datatilsynet.no) (Norwegian).
Images that require consent
- Photo with one or more people who are main characters.
- Illustration pictures.

Example: Photo where employees or students illustrate a real study or work situation requires consent. This also includes pictures that illustrate the various studies and student life. Photo: Benjamin A. Ward/OsloMet.Images that do not require consent
- Photo without people.
- Photo that are current and of public interest.
- Photo where the situation or activity is the actual subject of the picture. Situation pictures can be difficult to judge. If in doubt – always ask for consent.

Film and sound
AV Services
Employees can contact the AV Services for support. You can borrow audio visual equipment and studio facilities. AV Services can also assist with video and sound production, and streaming or recording of conferences and lectures (oslomet.no).

Consent for film and sound recording
Guidelines when streaming or broadcasting
When streaming or broadcasting films at OsloMet, you as the organizer are legally responsible. Information on sharing images on the Norwegian Data Protection Authority's website (datatilsynet.no) (Norwegian).
If you are going to film and broadcast events et cetera live online (streaming) with one or more people who are main characters, you must obtain informed consent from them. Consent form for live broadcasting at OsloMet (.doc). The consent form must be scanned and stored in Public 360.
If you are filming or streaming person(s) who are only involved in the situation and are not the main character(s) in the film/streaming you can use a different legal basis than consent. You are recommended to use "legitimate interest".
If the recording is to be published in FilMet, the person who made the film must complete a publication agreement. Information about FilMet's publishing agreements (film.oslomet.no, the website is in Norwegian, but the agreement is also available in English).

Streaming, broadcasting and photos using another legal basis than consent – legitimate interest.
Even if the publication of a situation picture or film/streaming does not have to be based on consent, there will still be processing of personal data if individuals can be recognized (datatilsynet.no) (Norwegian). In these cases, the personal regulations applies.
Before publication, you must make an assessment of whether the purpose of the publication is necessary to safeguard a legitimate interest that outweighs consideration of the individual`s privacy. Use the form for assessment of legitimate interest (doc) (In Norwegian). The assessment must be documented and archived in Public 360.
When need of help contact privacy contact in your unit/faculty.
You must inform those present about the filming. The information may be the same as information related to informed consent, except that you inform that the legal basis is "legitimate interest" and disclose some of the assessment that has been made. Alternatively, this can be done by having the information on a website (if many people are involved) or in a privacy declaration.
